 1. INTRODUCTION

1.1. Definitions

1.1.1.   “The Regatta” means a single-handed or a double-handed or four man transatlantic rowing regatta from San Sebastian in La Gomera to Port St. Charles Barbados in the West Indies due to commence on January 20th 2004.

1.1.2.   “The Regatta Rules” are all rules and regulations regarding the Regatta.

1.1.3.   “Competition Agreement” is the agreement between Ocean Rowing Society and the Competitor(s).

1.1.4.   “The Society” is the Ocean Rowing Society.

1.1.5.   “The Competitor” means the individual(s) who is/are party to the Competition Agreement and who will row in one of the boats to compete in the Regatta.

1.1.6.   References to any gender shall include all other genders and reference to the singular number shall include the plural and vice versa.

1.2. Organiser

The Organiser of the Regatta is the Society, which may appoint a committee to act in relation to the organization of the Regatta. The Society will have the sole and exclusive right to provide new boats designed by Roswell & Morrison and to be used in the Regatta by arrangement with the competitor. Or, Competitors may rent or purchase boats already built for an ocean row by arrangement with the respective owners.

1.3. Rules and Regulations

The Regatta will be governed by the Regatta Rules forming part of this Notice of Regatta, the Competition Agreement and such other rules and regulations as the Society may introduce from time to time. In the event of conflict the Amended Notice of Regatta will prevail.

 

2. CONDITIONS OF ENTRY, ENTRY PROCEDURE, PRIZES

2.1. Inspection

It is a condition of entry that all boats shall be freely available for inspection by the Ocean Rowing Society and that no attempt is to be made to conceal any feature of the boat. Each Competitor will be obliged to supply an up to date medical certificate shortly before the start of the Regatta confirming that the Competitor is physically and mentally fit to participate in the Regatta.  In the event of a Competitor failing to supply a satisfactory medical certificate by 30th November 2004 the Society reserves the right to arrange its own medical examination at the expense of that Competitor for which purpose the Competitor will make himself available to undergo such an examination.

2.2.  The Competing Boats

The Regatta is to be between single-handed or double-handed and four man rowing boats of the Ocean Rowing Society Class and may include any ocean rowboat that has previously crossed an ocean or was built for the purpose of crossing an ocean.

2.3. Competition Agreement

It is a condition of entry that the Competitor enters into the Competition Agreement, which will govern the rights and obligations of those training and competing in the Regatta and which deems to include this Notice of Regatta (or any amended Notices of Regatta). 

2.4. Entries

2.4.1. An entry form is available from the Society and details of the stage or entry fees are set out in the Competition Agreement. The closing date for entries is to be 30th November 2005. Late entries may be accepted at the sole discretion of the Society, which in that event reserves the right to charge additional stage payments or entry fees. The schedule of stage payments can be found in the Schedule C of the competition agreement. The ORS has made the total cost to enter the 2006 Atlantic Ocean Rowing regatta as reasonable as possible. There is no cost in receiving ORS regatta documents as ALL documents relating to the regatta will be posted on our website. The regatta application form can be found on the ORS website. Each competitor must print off and complete it fully, returning it with a non-refundable regatta entry fee of £250 per team and recent passport size photograph of each entrant. It must be returned to the ORS with two fully completed & signed copies of the Regatta agreement (both signatures in the case of double team). 

2.4.2. The number of entries will be limited to 60 boats.

2.5. Insurance

No boat shall be permitted to start the Regatta unless the Competitor has signed a declaration that he has read and understood the dangers of competing in the Regatta and has carefully considered his personal accident and life insurance requirements in the light of the needs of his dependants and will, if thought appropriate, seek additional life and accident insurance cover for the duration of the Regatta.

It is for each competitor to be responsible for insurance requirements.

2.6. Prizes

There will be the John Fairfax Atlantic Rowing Trophy for winning solo rower and commemorative medals for all rowers who complete the regatta.

 

3. ADVERTISING

Each competing boat will be required to display the logos of Ocean Rowing Society and the Regatta sponsor(s) (if any) in a predetermined position (logos to be supplied), as well as a designated competition number. There are no restrictions as of use any sponsors logos by any Regatta entrant. Further details will be supplied in due course by way of an Amended Notice of Regatta.

 

4. COMMUNICATIONS

The Society reserves the right to introduce, by way of an Amended Notice of Regatta, requirements as to the carrying of communication equipment on each boat.

Especially satellite equipment that is offered by various manufacturers.

Thrane & Thrane (Denmark) has been used on several ocean rowboats and is considered by ORS to be reliable. ARGOS tracking beacons are supplied by ORS and are compulsory on all boats. The cost of the beacon is included in the entry fee.


5. REGATTA RULES

5.1. The Regatta is a single-handed, double-handed or four man rowing regatta with one, two or four competitors per boat. 

5.2.  A Competitor may not be changed or substituted during the Regatta. In the event member of a double or four man crew retires for any reason the rower(s) left on board may continue but will be disqualified from the regatta. A crew entered as double at the start can not be reclassified as solo at any time during the regatta.

5.3. Each Competitor will be responsible for victualling his own boat. Apart from fishing, a boat shall not embark food, drink or equipment during the course of the Regatta other than the collection of rainwater or the use of a desalination or distilling plant on board.

5.4. Medical assistance may be obtained at any time. In the event of receipt of outside assistance other than for strictly medical purposes or to remove the boat from immediate danger only the boat will be disqualified from the Regatta.

5.5. Each boat is to be powered solely by the use of oars. Motors, sails (or any equivalent method of generating movement other than by the natural effect of wind and current on the hull or the Competitor wearing normal clothing) or other forms of propulsion are expressly prohibited.

5.6. The Competitor will ensure that his or her boat will as a minimum requirement have the items of equipment listed in Schedule 1 to this Notice.

5.7.  Any boat may at their own expense receive weather routing, or any other technical information during the course of the Regatta.

5.8.  Automatic steering by mechanical or electronic means by way of a wind vane is permitted.

5.9. All Competitors suffering from any medical condition, whether physical or mental, which might affect the Competitor’s performance or safety in the Regatta must report that fact, if practicable, to the ORS at least 30 days prior to the date fixed for the start of the commencement of the Regatta. In the event a medical advisor advising that the Competitor is not medically fit to compete in the Regatta the ORS reserves the right to revoke that Competitor’s entry without any recourse to the ORS. There will be no right of appeal against the decision of the medical advisor engaged by the ORS at the Competitor’s expense.

5.10. At least one life-jacket will be on board each boat for the use of each Competitor. Such life-jackets will be inflatable, provide adequate buoyancy and be fitted with a crutch strap arranged so that an unconscious person will be securely suspended face upward at approximately 45o of the water surface. The life-jacket will be fitted with a whistle, light and reflective tape.

5.11. The winner of the Regatta will be the first boat to reach Port St. Charles, Barbados and which has complied with the Regatta Rules, the Notice of Regatta (as amended if appropriate) and the Competition Agreement. Upon finishing the Regatta each Competitor will sign a Declaration confirming such compliance.

5.12. If any Competitors successfully row across the Atlantic but do not make landfall at the finish point of the Regatta their positions in the Regatta will be awarded only after the arrival, retirement or disqualification of all Competitors. Thus, if five people land somewhere across the Atlantic but at a point other than the finish then, assuming that fifty other rowers complete the Regatta, the highest place that could be awarded is 51st. This position would be awarded to the first of the five to make landfall with the next place going to the second person (s) to make landfall and so on.

 

6. MISCELLANEOUS

6.1. The ORS is the proprietor of all rights pertaining to and in the title of the Regatta, which includes all marketing rights in relation to the Regatta and the right to use the title of the Regatta and any logo in connection with the Regatta. Each Competitor maintains his/her book or film rights.

6.2. The ORS, its servants or agents accept no liability for any reliance placed by any prospective Competitor or anyone involved with any such Competitor unless and until that Competitor’s entry for the Regatta has been accepted.

6.3. The responsibilities of the ORS in relation to the Regatta are limited to compliance with any express contractual terms and the ORS will have no liability for breach of any term implied by statute or otherwise nor for negligence and shall not be responsible for any loss, damage or injury of whatever kind, other than for death or personal injury caused by the negligence of the ORS. The ORS will not be liable for misrepresentation, breach of duty or otherwise and under no circumstances will there be any liability for consequential loss or damage.

6.4. The responsible Competitor(s) will generally indemnify the ORS for any loss or damage sustained by it as a result of a Competitor’s breach of the provisions of this Notice of Regatta, the Regatta Rules or the Competition Agreement.

6.5. Competitors and those involved with them, including sponsors, shall be deemed to have notice of these exclusions and indemnities and shall not make any claim or bring any proceedings of any nature against anyone involved in the organization and management of the Regatta other than in connection with the contractual obligations of the ORS.

6.6. The acceptance of these exclusions of liability and the provision for indemnities are a pre-condition of entering the Regatta. It is the responsibility of the Competitor to ensure that these provisions are brought to the attention of anyone involved with that Competitor in connection with the Regatta.

6.7. The ORS will not be liable to any Competitor or any others involved in the Regatta for any actual or construed loss or damage, costs, expenses or other claims for compensation arising as a direct or indirect result of any cause beyond the reasonable control of the ORS including, without limitation, any act of God, force major, war, military operations, riot, accident, breakdown of plant or machinery, failure or shortage of power supplies, inclement weather, fire, flood, hurricane, drought, explosion, lightening, strike, lock-out, trade dispute or labor disturbance, the act or omission of, or refusal of any license or permit by any Government, national or international authority, highway authority, public telecommunications operator or administrative or other competent national or international authority, or difficulty, delay or failure in the provision, manufacture, production or supply by third parties of any information, goods or services. ORS will liaise with appropriate Spanish government agencies in order to have proper authority for ORS 2006 to leave from La Gomera.

6.8.  Ocean rowing is a hazardous activity and anyone intending to participate in or to become involved with the Regatta either as a Competitor or otherwise does so at their own risk and such individuals should recognize that they may suffer injury and/or loss or damage as a result of such involvement. The ORS takes no responsibility for such activities and those competing or who will otherwise voluntarily become involved with the Regatta recognize that such exclusions and indemnities on the part of and for the benefit of the ORS (and others involved in the management or organization of the Regatta) are appropriate and reasonable in the circumstances and recognize their own obligation to secure appropriate insurance and to bring this Notice of Regatta and these exclusions and indemnities to the notice of any third party involved or who seek to be involved in any way in the Regatta.

6.9.  In the event a ocean rowing boat crew is rescued any time after the start they will ensure that Argos Beacon is securely attached to the boat and is left in transmit mode, ORS will continue to track any abandoned boat and endeavor to retrieve such boat at a later date. Shipping and appropriate Coastguard authority in the area of such an abandoned ocean rowboat will be kept informed by ORS.

6.10.The office of Captain of Santa Port, Santa Cruz is responsible for giving permission, and/or permit for any ocean row to leave from any Canary Island Port. ORS will coordinate on behalf of all entrants, to comply with all regulations required.
